Iphone 4s phone receiver/speaker problem

Hi everybody, sorry if I'm writting about allready answered subject but i don't have anyone else to turn to....

To cut it short, when making a phone call i can't hear the ringing sound, or the person who answered. If i activate speaker, and then deactivate it, I can hear perfectly...strange 😟 😕

Is it a software problem or something else.

My phone is 10 days old and been having that problem from the first day. It is Iphone 4s 32G, serial starts with DNQG, software version 5.0.1 (9A405).

Also, the battery life is terrible, but that is a subject of completly different subject.

Talking about my phone speaker (on top) here...but when I tap the "loudspeaker" and put it back on phone speaker (on top), then it's ok.

Because of that, I know it's not a hardware problem...but how can I fix this?!
