If you mean it was stolen, report it to the polic and change the passwords for all accounts used on the iPod. If yu had already set up the FindMyiPod and wifi is on you may be able to find its general location. Apple will not help.
Who is "they"? Knowledge is key in understanding and resolving your problem.

If it is (the following word is very bad for Apple devices) jailbroken in any way, it most likely is hacked. (Believe me, it happend to me) so aside from restoring it, remove any strange packages IMMIDEATLEY.
