If you had already set up the FindMyiPod feature and wifi is on go to icloud.com and sing in and click on the FindMyiPhone icon and you may be able to locate it.  However, it is easy to defeat it, just turn off the iPod. Otherwise just look for it the old fashined way.  Apple will not do anything.

 

Change the passwards for all accounts used on the iPOd and repor it to the police.
