Cracked displays are almost always chategorized as abuse. As such, it is not likely to be considered a valid warranty claim.
If you bought your iPod with a credit card, check with your card company. Some cards provide Purchase Protection insurance which will replace or repair any item lost, stolen or damaged within 90 days of purchase.
