So I would say you are out of luck. If you live near an Apple retail store, I would bring it in and see what they say, but don't get your hopes up.

Here in the UK, this issue is covered for up to 5 years from the original date of purchase. The replacement top case with keyboard is fitted by an AASP or genius bar, they will not send you one.
