Smart Mailbox deselect Look in trash not working???

Hello,

I have a couple of gmail imap accounts. When creating a new smart mail box the option to deselect "Include messages from Trash" does not work, and whatever I do, I get all the rubbish in trash as part of the smart mailbox.

Most of the unwanted mail are actually copies of auto saved drafts from the time of composing new mails, located in "Trash"...

How can I fix this? Ie, not getting the search look in trash (as deselected by not selecting "Include messages from Trash"), make that choice work as it should?
