when i respond to a text (on imessage) but by the time i respond the reciving person has imessage ofline ( as in: does not have unlimited data plan so they have 3g off - becuase AT&T and every other phone compies want to offer less charge more.. BRING UNLIMITED DATA BACK! ) so my imessage never goes through!

You do understand that an iMessage takes very little data. Also, if you have your message setting set to send as an SMS if the recipient is not available for the iMessage it will go as an SMS. If the recipient is not available, the message should also que for later delivery.
Taling about AT&T, their SMS plans for most now account for very high message counts, or are unlimited, so sending as an SMS should not be a problem either.
Dude doesn't not matter if it uses or not data. If they don't have any left it might be for other reasons. Duh! Again: why does it not send. Mine does not switch from iMessage to txt message.
Okay. You do not say whether you have the setting "Send as SMS" turned on. What other troubleshooting have you done? Check this support document http://support.apple.com/kb/TS2755 for messaging troubleshooting.
