Siri is not an application. It is a service that you enable in Settings.

Are you absolutely positive you have a 4S and not a 4?
I'm positive it's a 4s and I e looked in settings and in restrictions and nothin
Then restore it as a new device. Do NOT restore your backup. If it still does not appear... well, I hate to tell you this, but it sounds like it's a 4, not a 4S.
...or the OP is not on iOS 5.
Its a 4s cause I got the thing that tells me where to find it but it's not there
He claims it's an iPhone 4S, which means it MUST be on iOS 5. The 4S was never available with anything earlier. If it is on an older version of iOS, then it's not a 4S, which means it doesn't have Siri and never will.
What is "the thing that tells me where to find it"?
Did you look under Settings > General > Siri?
Did you look under Settings > General > Restrictions?
If it's not there, you don't have a 4S.

Where did you get the phone? What does it say on the box? On your receipt?
It really sounds like you have a 4, not a 4S.
