Verizon restocking fee?

I'm considering returning my new iPad over the heating and charging issues, and getting a 4g hotspot instead to go with my good old iPad 2. I bought the new one at a Verizon store on launch day, without any intent of returning it obviously.

I know their policy states $70 restocking fee, but I'm curious if they would wave it because of an issue with the device. Has anyone tried taking their iPad back to Verizon?
