1. Jailbreaking is not illegal
2. You should not jailbreak your phone: jailbreaking voids your warranty with Apple, and forfeits your ability to any subsequent assistance from them or from this forum
3. Search this forum. You'll find literally hundreds of post of people who have permanently destroyed their iPhone by attempting to jailbreak.
Jailbreaking is not "illegal" in the same way that installing aftermarket car engine computer software isn't illegal. You can't go to jail or be fined for doing it, but forget about getting those cracked pistons replaced under warranty.
Jailbreaking the phone at best seriosly degrades the phone's security and susceptibility to malware, spyware and viruses. Most of the phones brought into Apple with strange instabilities had been jb.
Also, contrary to the claims of the hackers, jb can't always be completely removed by restoring the phone, and residual effects will plague the phone indefinitely - particularly when the modem baseband has been altered. In fact, you may never be able to update or restore the phone to a stock iOS again (error 1015).

It depends on what country you are in. In most countries, no. It is not illegal.
2;should i jailbreak my device.
No.

It will void your warranty and forfeit your right to support here or from Apple. You will also no longer be eligible for a discounted out of warranty replacement if the phone fails or is damaged.
Security and stability will be compromised. You may become suceptible to malware infections, etc. You may not be able to update to future versions of iOS. Depending on the jailbreak, it may become impossible to return the phone to a pristine state. If you have to restore the phone for some reason, it could be converted into an expensive paper weight doe to the damage done by the jailbreak.

If the jb is done properly, the phone can be used as an attractive door stop as well.
Lowe's sells doorstops that cost a twinge less than $600 ...
It could also be carried as a decoy in case you're mugged. You know... There might actually be a market for iPhone decoys now that I think about it.
Such fun sport, this.
But there seems something almost inhumane to it ...

But they don't have the panache. You're really making a statement using an iPhone as a doorstop!

I think that statement is "I am slightly less intelligent than a brick". đ
Good find. Thanks for posting that @b j t
Some people claim jailbreaking will turn your iPhone into an iBrick, http://www.dominikras.com/2012/11/do-you-prefer-iphone-or-ibrick.html. That issue is so common that Urban Dictionary has several pretty darn good definitions for it đ
