Jailbreaking is not "illegal" in the same way that installing aftermarket car engine computer software isn't illegal. You can't go to jail or be fined for doing it, but forget about getting those cracked pistons replaced under warranty.

Jailbreaking the phone at best seriosly degrades the phone's security and susceptibility to malware, spyware and viruses. Most of the phones brought into Apple with strange instabilities had been jb.

Also, contrary to the claims of the hackers, jb can't always be completely removed by restoring the phone, and residual effects will plague the phone indefinitely - particularly when the modem baseband has been altered. In fact, you may never be able to update or restore the phone to a stock iOS again (error 1015).

It depends on what country you are in. In most countries, no. It is not illegal.

2;should i jailbreak my device.

No.

It will void your warranty and forfeit your right to support here or from Apple. You will also no longer be eligible for a discounted out of warranty replacement if the phone fails or is damaged.

Security and stability will be compromised. You may become suceptible to malware infections, etc. You may not be able to update to future versions of iOS. Depending on the jailbreak, it may become impossible to return the phone to a pristine state. If you have to restore the phone for some reason, it could be converted into an expensive paper weight doe to the damage done by the jailbreak.
