I Have tried EVERYTHING!...I have cleared my phone completely to re load it without icloud..no difference. I have tried to restore my phone through itunes but whenever I try it downloads 5.1 (which I already have ) and half way through it says that it cant download...and then aborts the restore process.......HEEELP!

You don't need iCloud to copy photos to your phone. You can do that via iTunes:

iOS and iPod: Syncing photos via iTunes

I assume you are syncing to a Mac running Snow Leopard? Did you check for any new software updates?

Any security software installed?

Did you try to use another USB cable or port?

"Disk cannot be read from or written to" when syncing iPod or "Firmware update failure" error when updating or restoring iPod

What worked for me, having the same issue, was:

In settings, go to general/reset.

Choose reset all settings, this ereases teh settings, but no data or anything really important (wors't for me was the wallpaper) so really had no setback.

It will guide you to the process of setting up the phone, and once you finish, bang! there was iCloud ready to go.
