Did you try to set up an iCloud account as described in this article?
Thanks for your help,
Yes the problem is when asked about icloud after loading 5.1 I said no I don't want icloud...
now it shows on my settings but pail grey and I can't turn it on!
I dont know if I can unload 5.1 completely and then re-load it again?
OK so if you go to stage 2 of the page you show it says "if you have skipped the setup process" then go to settings and turn on icloud...
THIS is where my problem is..the iloud button is all grey and WILL NOT turn on...or select or anything...
The first time i was offered icloud i chose "don't use icloud"!
Try to set it up as new device, without using the backup afterwards:
http://support.apple.com/kb/HT4137
After that you should get the option to start all over again, including the iCloud setup.
thanks for all your help..I now finally have icloud
However I can't really use it until I upgrade to Lion....However I NOW CAN'T GET ANY OF MY PHOTOS LOADED ONTO MY IPHONE!!! v annoying as I am njust about to go and visit friends and wanted to show them my photos!!
I Have tried EVERYTHING!...I have cleared my phone completely to re load it without icloud..no difference. I have tried to restore my phone through itunes but whenever I try it downloads 5.1 (which I already have ) and half way through it says that it cant download...and then aborts the restore process.......HEEELP!

You don't need iCloud to copy photos to your phone. You can do that via iTunes:
iOS and iPod: Syncing photos via iTunes
I assume you are syncing to a Mac running Snow Leopard? Did you check for any new software updates?
Any security software installed?
Did you try to use another USB cable or port?
OK I am a complete mug!!! Just happens my son👿 was making movies on my computer not using his hard drive!! and burned up 30GB of memory!!!! ...I had none left ALL FINE NOW....😉

Yes, children, what would we do without them 😉
What worked for me, having the same issue, was:
In settings, go to general/reset.
Choose reset all settings, this ereases teh settings, but no data or anything really important (wors't for me was the wallpaper) so really had no setback.
It will guide you to the process of setting up the phone, and once you finish, bang! there was iCloud ready to go.
