I've bought a brand new 4s and it turned out to be a defect one, now it's been sent back so that I can get a handset to handset replacement. Now am concerned that this new one which am going to receive might be a refurbished one. I need to check the device, if it is a new one or a refurbished ? How can I do that ? Please suggest ...

There is no way to know. Apple can at their discretion replaced a failed iPhone with either a new unit or a refurbished one and there is no way to tell the difference.

does this mean that the new one am going to get might still have any other problems, unlike the brand new. Am really concerned about the fact that there is no way to find out if am getting a new one or refurbished and above all about the performance and quality of the product am gettting for the amount am paying....
Your brand new phone had a problem, so getting a brand new one is no guarantee that you'll have no problems, it it?
Some pople argue refurbished is as good as new because somebody has personally evaluated it versus just getting something nominally tested at the end of a production line.
Then too, you're turning in a used non-working phone but getting back a used working one.
The only method I know if works with the GSM iPhone 4, neither the 4S nor 4 CDMA follow the SN# structure of the GSM 4. IMO, there isn't really a need to worry if the phone works fine 🙂
But the point of having a new one for the customer is to ensure that there shouldn't be any problems right ?? And I believe that's the DUTY of APPLE and ensure the same...
Also the other thing I'd like to highlight here is that, if APPLE replaces my old one with a refurbushed, then I don't see the point in me paying the full amount, while other people only pay half(for refurbished one) of what I paid for a new one.
They gave you a working iphone in exchange for your non-working iphone.
That is their "duty" and that is what they have done.
They have done exactly as they should.
Your iphone was used when you gave it to them. You had used it. Therefore it was not new.
They have done exactly as they are required to do. You now have a working iphone.
yes, agreed that they'll give me phone which is in good working condition, but so does the handset which my friend is using since 2 months and no one expects that I pay full amount to that old 2 months phone, right ? I hope this does make some sense and add something to what I've been trying to point out here....
Absolutely NO, my iPhone was not a used one, as soon as it was opened from the sealed box, it's not working, so I gave them back in the store itself, they've checked - double - triple checked and sent it for replacement.
You had fourteen days in most countries (and more in some) within which you could have returned the iPhone for refund if was defective out of the box. If you allowed Apple to process it as a warranty issue, then Apple will replace your iPhone with a new or refurbished unit at their option. This is clearly stated in their warranty.
There is nothing more anyone can say on the subject. The policy is what is it; there's no point in debating the issue with your fellow users here since we can do nothing about Apple's warranty policies.

Thanks for the info and like I've said earlier my phone was a defect piece right out of the box and I gave it back to the retailer ASAP. So now can I expect a new one instead ... ??

Who is the retailer? What you get back is determined by
their policy?
If it was returned before their return period expired and they
state they will replace with new during that period, then you
should get new. If they only state they will replace the phone,
then you could get new or refurb at their option.
You need to find out what the store replacement policy is
and make sure to read the fine print.
