but the wifi needs to be turnd on, on the ipod and the ipod needs to be connected to a known wifi network

go to mobile me web site and locate ur ipod and u can lock it there

There is not way to prevent somebody from placing the iPod in recovery mode and restoring the iPod via iTunes. That will permenently delete yur information from the iPod but then he has full use of the iPod for his own use.
