Why won't the 'about stacks' file delete?

I have just bought a Macbook Air and the default 'about Stacks' document that is in the documents stack won't delete. I moved it to the trash but when i try to empty the trash it says that it cannot be deleted because the 'file is in use'. How do I get it to delete?

MacBook Air (13-inch, Mid 2012), Mac OS X (10.7.4)

Hi ...

If you have the Preivew app open, quit that before trying to delete that file.

A word of advice. That PDF file may come in handy and takes very little disk space. Best to keep it.
