If you still have the problem after restoring to factory defaults/new iPod theyu have a hardware problem and the logic board, the most expensive part, has to be replaced.
Try powering down, wait 20 secs and then restart that fixed my iPhone 4s. Hope that helps.
I have an iPod touch 3rd gen and I'll charge it for two or three hours then I'll unplugg the charger and just letting it sit there it will go down then Ill play an app and it will go up then I'll let it sit and it will go up and down I've reset and restored it it didn't work. And I've updated it to ios 511
