So I've done the whole hold the power and home button, it resets but still stays frozen on the black screen with the apple icon

Did you try to connect in recovery mode, described in this article?
Next try letting the battery fully drain. That can take awhile. After charging for at least an hour tyr everything again.

When fully drained there is no icon on the screen, the screen in blank/black like when the iPod is off or sleeping.
The way I know it's fully drain is because when I plug it in it has the battery icon with the plug, then after having it plugged in to charge it just stays on the black screen with the apple icon. At first it's dim like normal but brightens up like its going to turn on but doesn't and stays on that screen
Okay I did all of the steps but it gives me an error code 9. I clicked to see what it was about but the USB port works perfectly fine since I hooked up my other iPod touch. What should I do now? It gets ready to restore an everything but that message keeps appearing.
Has the software of your iPod been modified before?
Not that I know of, but it ended up working after so my iPod touch is working now :)

By any chance would you know why the speaker isn't working or how to fix it?
Did you try to reset by holding the sleep and home button until the Apple logo comes back again?
Does it work with headphones plugged in? If yes, did you try to play music in headphone mode, then unplug during playback and start playing music again after that?
If you toggle the volume, can you see the slider moving up or down?
Yes it works with headphones, but when I unplug it and try to play music without headphones, the volume box says headphones when I adjust the volume.
Check your headphone port for any kind of debris or lint, then try to plug in and out a couple of times. Seems your are stuck in headphone mode.
