Will apple keep my broken iPod when I buy a refurbished one to replace it?

Tomorrow I am buying a refurbished iPod for $100 to replace my one withe the destroyed screen rather than pay $200 for a brand new one. In the winter, when I got a new iPod touch to replace my broken one that was under warranty, they gave me a new one but also kept my old one (the new one from that time is now the one with the scmashed screen).

Will they keep this one when I give them the money tomorrow? Or is it different because it's not an 'exchange is ownership' as they called it when I got my one under warranty?
