That is the risk of buying a gray market iPod. In case it was not properly wiped, go to Settings > General > Reset > Erase All Content and Settings. Then connect to iTunes to set it up and select Set Up as New iPod. You do not need to connect to iTunes if the device is running iOS 5 or later, and you can just set it up right on the iPod. To check the version go to Settings > General > About > Version.

An exact error message would be very helpful.

With that being said, if you are getting a server error, then chances are there is a problem with either connecting to the server, or the server is having issues...

In the mean time, do every thing else you can with the iPod and iTunes.  Make sure you can connect to the App Store, down load some apps, connect to you home WiFi network, and so forth.

Are you sure you are not trying to set up a MobileMe account?  If you are, Apple took Mobile Me off line today....

And just so we know, what generation of iPod Touch do you have, and what version of iOS is it running?

It sounds like you uses up your free 5 accounts/uses. I would contact iClould and explain what happened.
