my niece cant remember her password for her ipod..now its disabled...how do i fix it without losing all her stuff....she never backed it up on her computer

Place the iPod in Recovery mode and connect to your computer and restore via iTunes.
Won't that erase the device, or maybe there isn't any other option since it was never synced with a computer.
There is no other option. It is a security feature. If it was not DIsabled then she may be able to backup the iPod and transfer purchases.
She can always transfer iTunes purchases by:
Downloading past purchases from the App Store, iBookstore, and iTunes Store
