Move the com.apple.finder.plist file out your user's Preferences folder, restart, and see if that fixes the problem.
How do I do that not sure on where to look for the user preference
Click on the Desktop, hold down the OPTION key, select the GO menu->Library. The Preferences folder is inside that obnoxiously hidden Library folder.
You might have an application in Full Screen Mode. Move the cursor to the top of the screen and the menubar will slide in. Click the "arrows" icon on the far right to exit Full Screen Mode.
Well, it's a little late but I found your topic because I had the same issue. After restarting or shutting down and booting up a couple of times (in one week) the menu bar just stays where it has to be.. I guess this solved itself? And I had this issue from the moment it came out of the box, so I did not adjusted any program or anything. The menubar just kept disappearing with no reason.
Alsot talked to a Genius about this and he said this could happen with some Macs sometimes under Mountain Lion.. With no reason.
