If you have never jailbroken it then the warranty is still valid. Nothing you need to worry about.

If you jailbreak, Apple will not honor the manufacturer's warranty, Apple will most likely detect it was jailbroken and refuse support, and this forum will not provide assistance.
Please do NOT jailbreak. You will join the legions who created very pretty paperweights.
If you jailbreak your iPhone, you will have no further warranty, whether or not you restore it, if Apple can detect that the iPhone was ever jailbroken. Not all jailbreaks can be removed.

Sorry, I miswrote, but the same policies on jailbreaking apply to the iPod touch as well.
If your warranty on your iPod touch has expired, then you cannot purchase an extended warranty from Apple. There may be third-party warranty services that would provide coverage, but I cannot recommend any.

I don't understand the question. You can buy anything you wish, whether you jailbreak your existing iPod, paint it flourescent green, or throw it in a lake. What you do with one product has nothing to do with your ability to buy something else.
As I said before ... please DO NOT jailbreak. People like me in this forum like to help others, but we CANNOT help with jailbreak.
And your continued efforts to try to find ways around Apple's policies on jailbreak may get you warned or blocked from the forum for any purpose, or this discussion removed at the very least.
