My spouse would like to use the new Dictation feature in Mountain Lion to write medical session notes. But Dictation sends everything you say to Apple. Is Dictation (or Apple) HIPAA compliant?

I work on Medicaid software development, so I am familiar with the legal ramifications of HIPAA (those not trained in the ramifications have not heard of possible 10 year federal sentences for losing a patient's private information).
I would say "no", but that is my opinion only.
First thing your spouse needs to do is find out if said dictation feature knows how to spell uvulopalatopharyngoplasty. As a medical transcriptionist, I have lost accounts to voice recognition and gotten them all back. And to answer your real question, I doubt it is...
No, it is not HIPAA compliant. First of all, HIPAA compliance would require that Apple enter into a business associate agreement (BAA) with the person putting the health related info into the system. Since Apple doesn't do this, it's not HIPAA compliant.
It is possible that it is also not HIPAA compliant for other reasons, but without a BAA it's a non-starter.

Check out Dragon Dictation. There is a module for medical transcription. And Dragon Dictation learns as well as being software that is on your machine, not run through the iCloud servers.
