Under Mtn. Lion, Mail doesn't stay in dock when I close it

Many times, but not always, when I shut down mail it leaves the dock. I have "Keep in Dock" checked. Also, I found that I have to close and reload mail to get it to read new mail (this is most common after it has sat overnight)--perhaps powernap is acting up?

Any thoughts?
