2nd Mouse and still doesn't work properly!

I just bought a second Magic Mouse to replace #1 which had problems. New, #2, has same problems: when Right click button is On in set up, Right click opens drop down menus. When computer awakens, the mouse tail is solid and buttons don't work. I have to reboot. Rather annoying. I've paired, repaired, booted, re-booted, changed batteries, tried w/ various programs.........next up will holy water. Any ideas?

PS The Mac Store mgr just scratches his head . . . "I'll be ******. Never saw that before"
