I had a problem with my hard drive, it just wouldn't start up. I got the Macbook Pro with Mountain Lion already installed and no disc with it.
They replaced my hard drive and told me to run all updates before i install Mountain Lion again. I assumed that it would let me install it for free.
The app store is trying to charge me for it?
What do i do?

did you purchase ML fro mthe app store? If so, sign in with the Apple ID used to make the purchase, hold the option key and click on purchases and click on download/install next to ML.
no the mac already had ML on it when it arrived so there is no purchase history :/

Just go to an Apple Store or call Apple Support and tell them about it. They will surely give you a redeem code for ML.
so how did Mountain Lion become installed on it if you never bought it??

because it came with it installed already on it, it came with the purhase of the mac
Ok, but you told us you got the Mac a year ago. At that time ML wasn't out yet!
ok i admit i may have got the operating system wrong which i had but this one i have with the new hard drive is very different
maybe you have 10.6 on it. check >about this mac and tell us what version your are running. also, you should be able to reinstall Lion from the app store using the method I described.
Click on the Apple logo in the top left corner, then on 'About this Mac' and tell us what version of OS X you have:
10.8.X
10.7.X
10.6.X
10.5.x
ahh it says 10.6.8, i had a more up to date version of it before. Iv ran all updates and nothing has changed
