If you didn't have the passcode lock enabled, all someone has to do is turn Find My iPhone off with your iCloud account settings on the iPhone, or remove the SIM card, or power the iPhone off, or restore the iPhone with iTunes as a new iPhone.

Location services must be turned on, Find my iPhone must be turned on in the iCloud settings on both devices, you must be connected to WiFi and both devices have to be turned on and connected to WiFi as well.
