I know that many only visit their parents when they want something but is it that hard to give him a visit so he can put in his password to his iCloud account so it can be removed? He did afterall give you an iPhone.

You don't need the password to remove an icloud account. If you are in the icloud settings screen and you see a box with his appleid in it and the box below is blank waiting for a password he is logged out, but the phone still remembers the last ID entered.

His info may still be on the phone in which case you will want to go to Settings>General>Reset and then tap erase all content and settings. BEWARE this will completely wipe the phone and restart it as brand new iphone. EVERYTHING will be gone.

Is he paying your cell phone bill? If so, you probably should be honoring his wishes.

Unless you can prove you are the original owner, Apple will not help you. You will either need to get the password for the Apple ID to which it is locked or get the owner of that Apple ID to remove the device from their account or accept that you have a paperweight. Sorry.
