Passcode Lock w/o Erase Data - 10 failed attempts?

Hi,

I was robbed of my iphone a few days ago. I believe that i might have had my passcode lock turned on, but the Erase Data option (after 10 failed attempts) was "off". I hadnt known of this Erase Option option until after my iphone was stolen. My question is - would my phone still be locked after 10 (hopefully, failed) attempts? Could the thief still retrieve the data in the phone at that point? If he then plugged into his iTunes account to restore, does the phone gets restored to its original factory settings, without all of my previous data? Finally, can somebody advise if the 4-digit passcode lock is easily hacked?

Thank you very much for helping me with my queries above.

Thank you very much. I was robbed of my cash, and my phone ... but the personal data in the phone are what concerned me most at present.

I have also done a Remote Wipe on the phone since, but my phone 3G/cellular data were turned off (was overseas then) at the time, so the Remote Wipe didnt get to work. Till now, it is still "pending".

Been distressed about this since the time, and am truly concerned that the thief could have access to all my data in the phone 😟 😟
