I was wondering if it does this, cause It did it with my iPod touch when I updated to IOS 5.0.1 directly from my device.

    In and of itself, no, a software update generally does not give you more space; usually it's the opposite as Apple adds more features to iOS. An update may, however, correct problems of the iPod erroneously reporting the amount of space used, or clear some caches and other temporary files that are no longer needed, either of which could give you more usable room.
