mac mini early 2009 8 MB Ram in ML

In a Mac Mini early 2009, in order to install 8MB Ram one would have to download the "Mac Mini EFI Firmware Update 1.2". I now have Moutain Lion on my machine and it says I do not need the update. Yet, when I try to run 8 MB of Ram it does random restarts. I thought I might have a bad stick so I swapped the ram in the ram banks and though it helped a little, it is still restarting.

The system runs fine

Screen freezes

There's a clicking noise in the unit

Restarts

Does Mountain Lion provide the proper firmware or is there another update to allow 8MB ram opperation within the early 2009 Mac Mini?

Thanks

Actually, there are many many sites that say such. The early 2009 can only handle 4GB without the firmware update. Here's the first one I found.

And here is the apple site with that actual update

I found a thread telling where to find the current firmware version on my system. I have the update already, which must have came with the OS upgrade. The only other option is the ram sticks. I bought PNY Mac Compatable sticks with the same stats as those from the factory; except 2x4 instead of 2x2. I have found though, many who claim Mac compatable are not really; at least not on all machines.
