    No. I never got one and it was super weird. I ended up calling a 2nd or 3rd time to confirm it had been auto-accepted because I was worried I'd be in the same position that you are. I'm not really sure why I never got it or how that happened. If you look back earlier on this thread there is a link to the Terms and Conditions so you can go accept it there.

    when i was on the phone ordering with the rep. i received that email after each phone order i did. i actually accepted the terms for both phones while i was on the phone with her. only one rep acknowledged today that i actually accepted the terms.

    Yes, tracking says it will be delivered tomorrow by 3.

    I never received a 'Terms and Conditions' email and even checked my junk mail for it. I ordered around 3:30EST on 9/14, and received the confirmation email at 3:32EST and a text message at 15:42EST. My order is still processing for my black 32G.

     

    If I don't get the phone tomorrow I won't be that upset but I don't like that some people who ordered hours after me will be receiving the phone before me.

    Here is my situation (https://discussions.apple.com/message/19640869#19640869) and I have spoken with 3 different managers today and so far they have given me a $240 (2 months of 6gb share with 2 lines) credit. And they are investigating what went wrong, and I should be getting a call tomorrow.

     

    Recap: Pre ordered my iPhone 5 upgrade from AT&T website at 3:07am EST and received my email confirmation from AT&T, added a line via the apple store app at 3:25 to pre ordered my second iPhone. The 2nd iPhone will be delivered tomorrow where as the phone ordered at 3:07am wont be here till Oct 4 ***???

     

    I would like some help, AT&T reps have being acting like politicians in this way. I say to them that there are people who have ordered online after me and they are getting their phones on the 21st, and the AT&T reps deny that is the case by saying maybe they are lying, maybe the went to the store, maybe they were adding a line. So I plan to call them on this with some help for the community.

     

    I am looking for anybody who pre ordered for their upgrade via the AT&T website any time after 3:07am EST and has received a tracking number stating their phone will be delivered tomorrow. Please email me your order number or cell phone number so I can prove to AT&T that it is not first come first serve as they say. If you are uncomfortable with that shoot me an email and I can you or send you my info or find some way of alleviating your concerns.

     

    Let me know if I can help any of you who are in my same position. Be clear them waiving the activation fee for this mistake IS NOT ENOUGH!!

    I just got off the phone with 3 customer service reps from AT&T.  They have stated that if you did not have your order in by 9:00AM Pacific time  on 9/14 and have received shipping info, that shipping info is incorrect.  You will be receiving an email tomorrow morning stating how sorry they are, but that their system is completely messed up and it was sending emails inadvertently. 

     

    I have my receipt in hand stating I ordered mine at 7:16 Pacific time.  They keep saying 9:00AM Pacfic time was cutoff.  One lady I spoke to said that I didn't order mine until 10:17.42 Pacific time.  I told her I would scan my receipt and email it to her showing the exact time I sumbitted my order.  No dice on that one.  This entire process has been absolutely nightmarish.

    Same thing, Apple's site incorrectly would not let me order a new line so I had to go with AT&T.  I ordered 2:22AM PDT on 9/14.  I did not receive any confirmatory emails, nor T+C email, and trying to add terms and condition manually didn't work because it said I didn't need to add them.  The order did show up in my account for 9/14, and was converted to backordered.  I thought I had a tracking number but it turns out the automated system was giving me one from my order two years ago!

     

    I called to clear up some other issues.  Two very courteous reps said my order would ship on 9/21.  One said the cutoff time was 9AM PST and the other said it was 3AM PST.  After reading the posts here, I am not sure if they were given correct info about the shipping.  I am not going be upset if it gets here next week, but if it takes 3-4 weeks then my daughter (who saved up money for this phone and bought it herself) will be sorely disappointed.

    Okay so here is where I am at since everyone else is chiming in.

    I ordered on release date at a brick & mortar local AT&T store at around 9:00am EST. I ordered a black 32gig iPhone 5. I went the previous day and spoke with the sales associate and made a relationship with him where he understood what I wanted and how I wanted it added to my account as far as which line I was upgrading. I showed up that morning and I was the first person he waited on.There was already a line to preorder.  Immediately after the purchase I received an email stating it would ship in 14-21 days. I walked back in and asked him about it because the AT&T website still listed Friday the 21st delivery dates. He said not to sweat it, that it would arrive Friday. I was on backorder until about Tuesday and then it stated that it had shipped on Wednesday using that link to get the extra info but did not supply a tracking number. I received Fedex tracking number this morning when I woke up. However I was still a little worried because like many of you the initial charge for the phone had been reinstated to my bank account. Then this evening I checked my online banking and BAM the charge is there, not pending, but posted. And my phone is in transit right now with a delivery time of tomorrow evening.

    So there it is, I am no AT&T fanboy but they have done me right over the years that I have been a customer. One thing I like is ordering in store because that salesperson gets commission and therefore they want you to have your products just as much as you do, plus its always better to do business face to face than in cyberspace any day in my humble opinion. So theres my story, and I am sticking to it, hope that sheds some light for someone.

    @bfrick10 OMG! ATT doesn't have their stuff straight. i ordered my phones well before 9am pst. my phones are still on back-order. you make me want to call to see what run around i get. here are the headers of the terms and conditions i was sent minutes if not seconds after i placed an order with my first phone. they're dont know what they're talking about.

    @choe- Now that you mention it, the last time I went through this was with my iPhone 4. I also pre-ordered in person at the local AT&T store and got it delivered on the correct date.  Hmph.  Lesson learned, I suppose.  I now wonder if these online screw-ups by AT&T are intentional, so as to drive foot traffic to their retail stores.

    I placed my order in at 12:53 and 7 seconds pacific time, and I am being told that it will not arrive until. Oct. 5... It's such BS!!

    WOO FRICKEN HOO!  Wife's phone status now has a shipping number even though mine still is "backordered."

     

    Alright AT&T!  Even if I have to wait for my phone, I'M GETTING LUCKY TOMORROW!

    For what it's worth, a service rep told me that the orders are not fullfilled in the order they are placed, but rather in the order that they are fully processed.  I placed my order at 3:45AM EST on 9/14, but my order did not finish processing until 2:40PM, according to the rep.  So even though I ordered very early, from AT&T's perspective I didn't order until that afternoon, which is why I am not supposed to get my iPhone 5 until 10/4-10/15.  When I asked why my order in particular took so long to process, she said she "cannot disclose" that information.  So who knows.  She assured me many customers are in the same boat.  Bottom line is something went wrong with their system and "first come, first served" just didn't happen as it was supposed to.  I am supposed to be contacted by a supervisor sometime in the next 24 hours, but I very highly doubt anything good will come of it.
