Two days ago I purchased a Iphone5 from at&t and all the phones I've been mentiong I've bought a ringtone for each one of them with the same apple account, same card, username and everything and for some reason i cant get accsess to my ringtones now. I have lost them all. What can I do to get them back?

Are they visible on the Music page. If so click on the cloud to re download them.

Jan 25, 2013 10:41 AM in response to Lanakekiniby turingtest2,Ringtones and certain other content such as audiobooks are excluded from repeat downloads. If purchased directly on an iOS device you should have transferred these into an iTunes library at the earliest opportunity, and then backed up that library.

My ringtones suddenly dissapear from my iPhone for no apparent reason, I cannot find them in my iTunes and now I find out I have to pay again?
Theft.

It's all there in the terms and conditions that you, presumably, didn't read, and a factor of the agreements that Apple are able to negotiate with the rights holders. You should have taken your own backups to secure your purchases. If you accidentally mislaid a CD you wouldn't go back to the shop and ask for a free replacement would you?

That makes it theft.
Period.
No judge in the world would rule any differently if this were a court room.
The applicable sections of the terms and conditions would be ignored for the purpose of a ruling and Apple would be instructed that those sections are not legally enforcable because the policy is not consistent.
The only reason Apple hasn't landed themselves in a pile of poop over this is because nobody will sue for $0.99 and they know it.
I'm not a lawyer but I deal with legal issues every single day in my work.
I know it is theft.

Competition changed that, but vested interests resist change. Audiobooks, iTunes LPs, iTunes Extras (a recent change), Digital Booklets, iPod ClickWheel games (no longer on sale), selected movies & TV shows and tones are still sold on those terms. Any of the content that you can redownload is subject to removal from the store with no notice at the request of the copyright holder. Make your own backups!
I've never purchased a ringtone from the store (easy enough to roll your own) but I can imagine that Apple don't save the selected start and end points, they take the payment, register which track needs to have royalties paid on it, and create the file for you. There is no copy of the ringtone you created at their end to send to you again and unless they record the details it isn't technically feasible to restore "your" ringtone. They could, I suppose, let you carve a new one from the same track, but that would require a renegotiation of the contracts with multiple parties. Come to think of it I'm not even sure the feature to make ringtones with iTunes is still there!
Apple didn't deliberately reach into your phone to remove the tone. There is no "theft". There is no mens rea. Accept that you made a mistake in not taking greater care of your content, and move on.

I should have mentioned in my previous comment that what I do for a living is write, evaulate, revise and finalize corporate documents, standards, procedures and policies. These are legally binding corporate documents. My particular area is in corporate safety polices but there are others on our team who specialize in production polices, public relations polices, HR policies, quality assurance policies, contract vendor polices, the list goes on. We deal with lawyers all the time and we hear the same thing every single time. Consistency, consistency, consitency, across the board. I absolutely promise you that whatever Apple once did is completely irrelevant. If they allow reloading of music now then they must allow reloading of rintones and audio books as well. Music is absolutely the same product as a ringtone or an audio book. It is a digital sound file. Period. No court would ever see it any other way.
My ringtone is one I made myself. I purchased the other ringtones soley for their comedic value.
Earlier this morning I decided to place a few more pics on my phone and for some unknown reason the status bar across the top said "Downloading Ringtones" during the sync process. My comedy files are back in my library and loaded onto my phone. I will not ask why. I know better. Thank you for your time.

It is clear that policy is changing as new contracts are negotiated with the rights holders, but for now different rules still apply to different content and in different regions.
So your tones were in your library after all. Great. Hope you've backed up too. To err is human, to really mess things up you need a computer.
