-update iCloud control panel from v1.1 to v2.0 (2.0 was released 9/12/12)
-sign in again after reboot, you will be asked to accept terms and conditions
-go login to photostream on your apple TV
in other words, updating the iCloud control panel triggered the new T&Cs.

Someone further on in this forum suggested that all you have to do is update to the most recent version of the iCloud control panel. See: https://discussions.apple.com/message/19869646#19869646
It's just a matter of getting one of your devices to prompt you with the updated terms of service. See my earlier link: https://discussions.apple.com/message/19855327#19855327?ac_cid=sa123456#19855327 for more ideas on workarounds.

Been there, done that, accepted the new t&c's but still no luck. Thanks anyway and surely Apple will come up with a fix...or am I dreaming?

Have to live without photostream, just use airply
Will wait for another 1-2 weeks before apple fix this bug, otherwise will restore to the previous version

I did"nt know about the new Icloud control panel 2.0...It worked for me.

Oct 4, 2012 3:42 AM in response to Joshua Braunby Stevewelham,Updating the iCloud Control Panel didn't work for me. I think this may have been because I updated the iCloud Control Panel before updating my Apple TV.
Once I'd upgraded the Control Panel, no amount of uninstalling and reinstalling seemed to prompt me to accept new Terms of Service.
It seems I was only saved by the fact I had an iPhone that hadn't been updated to IOS6. It was this that finally prompted me with the new Terms of Service.

I reset my AppleTV to factory settings, but as part of this it downloads the latest update!

Try the above link it solved my problem by changing the country form store to another one and reverted back to the original country, go to the iCloud it will show the TOS agree and viola it worked on photo stream, the only thing apple must do the fix not the community which we list hours and days effort to fix this.

It can work for you or not but in my case it worked.
