iphone 5 mute / ringer switch button not working

My brand new iPhone 5 is having an issue with the mute/ringer switch. When I lightly touch the switch, it goes into silence mode for a brief second, then goes into ringer mode. When I flip the switch over to silent, it buzzes and briefly displayes silent mode before displaying ringer mode. It appears the switch is "activated" by a light touch rather than actually flipping the switch. It appears to only want to stay in ringer mode no matter which way the switch is flipped. Do I have a hardware problem that I need to return my iphone 5 or can this be fixed otherwise?

Anyone have any suggestions before i take my new phone back to the Apple store and request a new one?

Sounds like a hardware issue best addressed by your Apple dealer.

I had the same problem with my iPhone 4 and now with my iPhone 5. Also the switch is starting to feel like it's binding up - getting very difficult to flick.

zolds, How did you solved the problem? I just got my iphone yesterday and even without touching it, it buzzes and briefly displays silent mode before displaying ringer mode, it does that 3 or 4 times and then stop buzzing.

Hi Migueru, I took the phone to the Apple store and they swapped it out for a new one. Since all my data was backed up on iCloud, it was minimal hassle. New phone works great.

if it is not a hardware failure, i.e. the vibrate/silent switch is not dirty or shorted, then try going to settings sounds and at the end turn off lock sounds and keyboard clicks. And the try the switch one more time. That did it for me.
