Unlocking iphone in another country - legally
if i have moved to Australia and cancelled my account with AT&T how do i then legally get my phone unlocked?

you need to call AT&T and see if you qualify for unlocking. Carriers lock phones. Only carriers can unlock them. This has nothing to do with Apple.
