i have the first generation of ipod, itunes says that it is up to date and their is no software update option on my settings.

The original ipod touch can only go to 3.1.3
Updating from the ipod itself is a feature of ios 5 and above.

iOS 6 is supported on the 4th and 5th generation iPod touch. Open Settings > General > About and see Version. If you don't use iOS 3.1, you can purchase iOS 3.1
Apple is no longer updating software for old devices.
