Too Late for covered repair?

My MB Pro (Early 2008 4,1) has been having some video card glitches for a while, but none that serious until this last week. Now I'm getting frequent kernal panics and/or my screen will go nuts. Is it too late to get it repaired free of charge? I just learned about this issue and Apple's 4 year extension.

MacBook Pro, Mac OS X (10.7.5), 4,1 Early 2008 model

You can take the Mac to an Apple Store and it will be repaired without paying anything

Well, I did my best to charm the guy at the Apple store, but to no avail. I was 2 months past the 4 year deadline and they wouldn't budge. It cost me a flat rate of $310 for the repair which included a new logic board with a new graphics card. I couldn't find one online for that price, so I went with it.
