They have the Battery Replacement program which was rolled out this august only , they made defective battery for some phones and they should replace it.

Yes. They have a battery replacement program. If your phone qualifies, all you have to do is make an appointment at the genius bar of an Apple Store located in the country where the phone was originally sold. The E.U. is considered one country for service purposes. If that's not acceptable to you... well, you should have thought about that before purchasing a phone from a country other than where you intended to use it.

From the page you linked to:

Now, there is a line below that that says:

So, if you pay to have the battery replaced, you MAY be able to get a refund.  MAY.  No Guarantee.

    hi,

To All i Got my battery replaced by authorised apple support centre in India totally free , since my iphone5 is eligiblefor replacement when i check my serial number . they have mentioned the clause "may  limit " not  'for sure' . so it means they can do it if they think it is possible ! i called apple care they did some diagnosis test and said i have to go to service centre.

so people if your battery have problems in iPhone 5 check your serial under that battery replacement program , go to nearest show room ,service centre and give it .
