i just found a website with the same name and they sell the same thing as me

i just found a website with the same name as me and they sell the same thing as me the only diffrence is they are a .com and im a .org what does this mean is one of use doing somthing illegal we both have a copywrite on our websites

There's nothing illegal about the domain name.


I can't comment about the content without seeing the actual sites.


Its not very good for any business to be competing with one of a similar/same name. Presumably you must have known about the competition when you researched your domain name if their business and website existed before yours.


It might be better to bite the bullet and change yours. The longer you leave it - the harder it will be to change all the SEO.


The name must effect your competitor too so you could try selling it to them!

If one of you has a US trademark on the company name, the other might be infringing on that trademark. Most small web-based sellers don't bother with the cost and hassle of getting a trademark. But, to be sure, you might want to search the USPTO web site. You are looking for a live trademark of the same name AND in the same line of business. Two companies can have name if their business lines are different enough.
