So I have warranty on my iphone4s and my phone4s is messed up but I'm going to the apple store. So they'll probably give me a new one but is there anyway to get the iphone 5 instead?

Jenny, my experience is that they return an iPhone 4s for a 4s, 4 for 4 etc.

No. If you get the phone replaced, it will be with an identical model. If you want an upgrade to an iPhone 5, you will have to buy an iPhone 5. Apple does not do trade ins.
