deleting file from trash
I have files in my trash that I cannot delete

option (alt) + empty trash
Do you get any sort of error message?
There are a number of reasons why you might not be able to delete files. The most simple rememdy is to reboot and then try to empty the Trash. If this doesn't work, you may have permission problems, etc. So try rebooting and then try emptying the Trash again.

If a Restart doesn't allow you to Empty the Trash...
Goto Finder > Help > type in Trash...
From Finder Help Trash...
" Empty the Trash
Command (⌘)-Shift-Delete
Empty the Trash without any warning or when it contains locked files
Command (⌘)-Shift-Option-Delete
Hold down the Option key, and then choose Finder > Empty Trash "

no error message i have tried to move it back out of trash and it wont as it says the file is locked

I had the same problem with 4000 photos in trash. I found that if I opened Aperture, electing to use the iPhoto library, the trash delete in Aperture works fine and also deletes the iPhoto trash.
