Will I have to pay for a replacement battery?

I was charging my iPod touch 3rd gen and went to pick it up. It was burning hot, so much so it burnt my hand. It no longer works. It isn't covered by warrenty. Since the malfunction was potentially dangerous, will I have to pay for a replacement battery?

Very unlikely since it not within warranty. You can always make an appointment at the Genius Bar of an Apple store and hear what they have to say
