Of course you don't have to update. Most updates offer new features, & bug/security fixes. If you don't want to update, you don't have to. Just be aware, as developers update their apps, some apps may require you update the iOS to continue to use the app. Also, if you ever restore your phone, the current iOS version, for your model, will be installed.
as you advice we need to update our 4S to iOS6 to be able to coupe up with new apps. do we need to jailbreak our 4s? or just click/press update and it will do the rest. no need to jailbreak am i right because i dont want also to jailbreak my phone.

Of course you don't have to "jailbreak" in order to update the iOS. Why would you even think that? Now, if your phone is already hacked, let's say to unlock it or for other reasons, updating software will error out, leaving your phone in an unuseable state. Such can be fixed, but we can't help you here. It your phone is not hacked, you have nothing to worry about.
