Q: Legality of using audio files from FCS in movie project?

Yesterday I made a home movie of some Bluejays and set it to music and used some sound effects from FCS.  Later that afternoon FaceBook took my movie down for suspected copyright infringement.  I need to know two things:  How do you cite the music or sound effect in the credits you use in a project?  And, I've purchased all kinds of production music from many different vendors.  Those vendors supply you with the documents to use if challenged, but I haven't found anything on using Apple's supplied audio files.

 

I've bought a bunch of Jam Packs too and the only reference Apple makes is to check with your legal advisor.  Are they saying I have to hire a lawyer to use their products?

    This happens all the time – notably with You Tube. Do a Web search on Apple Audio content legal usage.

     

    Here is a link to Apple's legalese. It pretty much says you're good to use their content except for commercial use.

     

    There was a recent thread on these boards where someone said these copyright claims were easy to straighten out. Do a search of the boards and see what they recommended.

    The relevant section of the Apple Soundtrack Pro license:

     

    2. Permitted License Uses and Restrictions. This License allows you to install and use one copy of the Apple Software on a single computer at a time. You may use the Apple and third party audio loop content (”Audio Content”), contained in or otherwise included with the Apple Software, on a royalty-free basis, to create your own original soundtracks for your video and audio projects. You may broadcast and/or distribute your own soundtracks that were created using the Audio Content, however, individual audio loops may not be commercially or otherwise distributed on a standalone basis, nor may they be repackaged in whole or in part as audio samples, sound effects or music beds.

    Translation - The Apple loops are rights free as long as you create your own composition with them. What you can not do is sell the individual loops.
