the 'terms and conditions' notice is not coming up on either my iPhone or OS X device.

I can not connect to my Photo Stream with my new Apple TV. I keep getting this screen:

"Unable to sign in

...terms of service have changed..."

i have followed the instructions here and there are no new terms of service coming up on either my OS X machine or IOS device.
