The first step in Upgrading... is to Snow Leopard = OS X 10.6.x
It is Not available as a download... It is a Paid Upgrade.
Do this first...
Check that your Mac meets the System Requirements for Snow Leopard...

If so... Purchase a Snow Leopard Install Disc...

Other countries...

After the Successful Install, run Software Update to get the latest updates for Snow Leopard.
Be sure to make a Backup of your Current System Before Upgrading...

i've also tried to do a software update and it saids my computer is up to date

I have seen others post that Apple will sell you Snow Leopard to allow upgrading to Mountain Lion (or Lion if you Mac Pro won't run Mountain Lion).
I don't know the details, but I would contact Apple sales before trying to buy Snow Leopard from somewhere else.

You didn't type whether or not you were going to try to upgrade to Mountain Lion. If so, you can check computer campatibility here:

You can also check the model number to find out when the computer was really built. To get the model number go to "About this Mac", More Info" and then "System Report.":

You might also want to check for application compatibility if you are contemplating Mountain Lion. PowerPC applications aren't supported:
