This is deception on Apple's part if it sold to me as 3rd generation, but now to upgrade or buy apps it's labeled as 2nd generation.
Can someone clarify?

A1288 is a 2G. Further it appears your iPod can only go to 4.2.1 and that indicates it is a 2G iPod. Also, Apple only made 32 and 64 GB 3G iPods while the 2G was made in 8, 16 and 2 GB models.
What made you think it was a 3G?
It is a 2nd gen.
Because the 3rd gens are only 32gb and 64gb there is no 8gb 3rd gen ipod. If you have a 3rd gen you can update to ios 4.2.1.
If you have 2nd gen 4.2.1 is the latest and highest version of ios it can go up to.

When I bought it, it was advertized as a 3g. In fact the sales person (@ Apple) specifically said it was b/c the older version didn't have a volume button.
so is there no way of buying apps for it anymore?
He was right, the older version (1st generation iPod Touch) did not have a volume button. All versions since the 2nd generation has had volume buttons.
Sorry very little apps support ios 4.2.1. Most need ios 4.3 and later. Sometimes they even need graphics compatibility.
I bought a 3rd Generation ipod touch, but the code A1288 says it's 2nd? WHY?
