my ipod does not have the software update option
When I connect to itunes to update my ipod it tells me my ipod is updated but when I try to download an app it tells me I need to update to iOS 5. How do I fix this problem?

I suspect you have a 2G iPod. Those can only go to iOS 4.2.1.
