my phone lucked me out and will not take my pass code

My iphone 4s is acting up , some time it takes my screen code some time reject , I have no Idea what to do Iam afraid to restore and loose all my Data and files , I do have my user name and pass word with the Itune store but the screen pass code is not working some times , what could be the problem.
