You are given the option to restore to your iCloud backup when you first set up a new phone (see image below). If you already set up your new phone, you'll have to erase it, then go back through the setup again to access this option.
To do this, tap Settings>General>Reset>Erase All Content and Settings. Then follow the on-screen setup again, choose Restore from iCloud Backup when given the option, then select the backup from your old phone to restore from. Be sure your phone is connected to wifi and your charger as restoring an iCloud backup can take a while to finish.

Jan 12, 2013 9:48 PM in response to randers4by amit.bansal,I dont want to retrieve it on my new iphone as my new iph has new things in it and different settings all together and i will lose all the new data thats saved on the new iph at the moment, i just want to retrieve those photos from icloud that has been backed up from my stolen iph to my computer, i went and searched it on the search engine and they asked me to go to system preference and then to internet and wireless and there should be a icloud option there, login in my icloud account from there and back it up but sadly my mac is not even showing icloud option under system preferences and internet&wireless.

Jan 13, 2013 7:51 AM in response to amit.bansalby randers4,If the photos you are looking for are in the backup from your old phone they can only be recovered by restoring an iOS device to the backup. If the photos are in photos stream and are 30 days old or less, they can be access by a Mac running OS X 10.7.2 or newer or a PC running Vista SP2 or newer by syncing it with your iCloud account. (Photos older than 30 days are no longer in your photo stream).
